Profile
- Mr. Tian Qirui, male, Communist Party member, full-time postgraduate of civil and commercial law, full-time lawyer at Shanghai Hiways Law Firm, has earned the title of “Excellent Lawyer of the Firm” for four consecutive years. Since practice as a lawyer, he has completed more than a hundred litigation cases and a large number of non-litigation cases, specializing in marriage and family, real estate disputes, inheritance, traffic accidents, civil and commercial contract disputes. - 1.Represented a creditor in the bankruptcy and liquidation of a metal sales company in Wenzhou, successfully collecting RMB 9 million in arrears.
- 2.Represented a creditor in the bankruptcy and liquidation of an air conditioning manufacturer in Wenzhou, and successfully collected RMB 25 million in arrears.
- 3.Represented a worker from Yunnan Province in Shanghai in a death compensation case of Mr. Yang. Although evidence proving that the injury was work-related was absent and the employer refused to report the injury, I successfully reported the injury on behalf of the deceased through negotiation with the employer, and was recognized as a work-related injury, which resulted in more than RMB 400,000 medical expenses and RMB 730,000 compensation for the deceased.
- 4.Represented a Shanghai-based bill discounting company in a lawsuit against the chairman and de facto controller of a well-known listed company, which resulted in the full support and enforcement of over RMB 8 million in principal and interest.
- 5.Represented Chen in a divorce dispute: Chen immigrated to Sweden with her child shortly after birth, and the child himself also obtained permanent residence and received his education in Sweden. As Chen's representative, after her husband secretly sent the child to Singapore, I applied to the court for measures to restrict the husband's entry into and exit from the country in order to fight for the custody of the child, eventually forcing him to send the child back to China to study in Shanghai and Chen is guaranteed custody and access rights to the child.
- 6.Represented Gui in a divorce dispute: Gui had been working as a full-time wife at home after her marriage, and soon after her husband changed his status to that of a Hong Kong citizen, he proposed to send her and her children to the UK so that the children could study in the UK. Soon after Gui and her child left for England, her husband cohabited with a third party outside of marriage, and when Gui found out, she returned to Shanghai and filed for divorce. In addition to securing tens of millions of assets for Gui, I also helped her secure custody of the child and paid her 30,000 RMB per month for child support.
- 7.Represented Xi in the custody dispute of her child born out of wedlock: Xi registered her marriage with her boyfriend in Las Vegas, USA, and gave birth to a son in the USA, who had been raised and cared for by the woman. Later, Xi returned to Shanghai with her husband. The husband took the child away and sent it to his parents to take care of him. He refused to register a marriage with Xi. After many negotiations, Xi had no choice but to file a lawsuit in the court. Xi's agent finally won the custody of the child and Alimony for Xi.
- 8.Represented a relative in a Taiwan-related inheritance dispute: the parents of the decedent were defeated in Taiwan with the KMT in 1945 and the decedent was only a few years old at that time and stayed in China to live with his grandparents. In 2015, the decedent was diagnosed with cancer, but his parents in Taiwan were still alive. In order to arrange for his own assets after death, the decedent made a will on his real estate, savings and various assets in Shanghai, which was in duplicate. The will was mailed to both parents in Taiwan along with other paperwork. Shortly thereafter, the decedent died and her spouse, our client, filed an inheritance suit in court. As the parents of the decedent gave birth to other children in Taiwan, the other children were not satisfied with our client's will arrangement and refused to accompany their parents to China for court appearances and negotiations, so the succession could not continue. After coordinating with the court and sending the hearing materials through the SEF and SEA, the court finally heard the case in absentia and ruled that all assets under the decedent's name were inherited by our party.
- 9.Represented a foreign-related training contract dispute: Our client signed a helicopter training contract with an aviation school in Shanghai and paid a training fee of RMB 1,500,000, after which the Shanghai aviation school sent the client to an aviation school in Florida, USA for training. There was a dispute between the trainee and school with regard to fee payment and school transferring. In the case of the training contract dispute, all the evidence materials that needed to be prepared were told in advance to the trainee in the U.S. and sent back to China after the notarization and certification procedures were completed in the U.S. Finally, with the joint efforts of the lawyer and the students, the court ordered the aviation school to compensate the students RMB 840,000. After receiving the compensation, the trainee found his own aviation school in the United States to continue his study, which he completed in August of this year and returned home at the end of August after obtaining all the licenses.
- 10.Represented Pu in a housing requisition compensation dispute: completely disqualified his brother's five-member family as tenants-in-law, and ensured that the requisition compensation went to him and his sister.
