  • Peter Huang has comprehensive expertise in IP litigation, particular in the complex trademark and unfair competition, copyright and patent disputes. Peter represented numerous well-known multinational clients including New Balance, Spin Master, Scotch Whisky Association, BABYZEN, Diageo, Universal Studios, BRITA, Burberry, VALEO, MARS, INES, etc.

    Peter obtained master degree from FUDAN law school, and he has been the invited researcher of the IP Center of FUDAN University since 2015. Prior to joining HIWAYS, Peter worked as the leading attorney in the shanghai office of LUSHENG Law firm (a member of Rouse & Co. International LLP). Peter delegated a series of landmark IP cases.

    Peter is a senior IP litigator and the deputy director of the IP litigation department in Shanghai office.

Representative Cases

  • Copyright

    Represented Universal Studio in its lawsuit against a copycat got the full claim of 5 million compensation, which is the highest compensation for the fine art works infringement case in mainland China.

    Represented a leading international toy company in winning its first criminal judgment based on works of applied art.

    Advised a world famous movie producer on its IP licensing & IP protection strategy in China and regularly dealt with enforcement authorities and other government agencies in connection with actions against infringers in China;

  • Unfair Competition

    Represented a leading US sports goods manufacturer in its litigation based on the right of unique decoration and winning USD 1.5 million (RMB 10 million) compensation. It was regarded as one of the largest IP infringement compensation ever granted to a foreign company in China, and therefore received widespread overseas media coverage, including The New York Times, Reuters, BBC, etc.

    Represented a leading US sports goods manufacturer in acquiring two interim injunctions from Shanghai Huangpu Court and Suzhou Intermediate Court, which are extremely unusual in suits based on the right of unique decoration. And Suzhou intermediate court even issued a highest penalty on defendant’s refusal to enforce the injunction order, which was awarded one of the Top Ten IP cases of China courts.

    Helped a leading US sports goods manufacturer got RMB 10.8 million compensation against a copycat in PUDONG court.

  • Trademark

    Represented an international scotch association in winning its 1st collective trademark lawsuit in China;

    Represented the world’s largest spirits group in winning more than 30 civil and criminal lawsuits in China;

    Represented a leading water optimization expert in obtaining its first IP criminal judgment in China.

  • Patent

    Represented a famous Canada toy company in winning a series of lawsuits against domestic copycats based on patents;

    Advised a leading international toy company regarding its patent litigation strategy in China and helped it to acquire a controversial patent for free from a large-scale domestic toy manufacturer;

    Represented a high-end French stroller brand as defendant in 7 patent lawsuits instituted by a Chinese infringer and filed a countersuit to the infringer’s malicious litigation, ultimately leading to a favorable settlement and receiving the compensation of USD 315,000 (RMB 2million);

  • Anti-Trust

    Advised a world famous luxury goods brand on the anti-trust investigation concerning abuse of IP rights, and finally the NDRC cancelled the investigation;

  • Others

    Represented numerous multinationals including MARS, BRITA, VALEO, ABF to deal with more than 100 investigations launched by government agencies in China;

    Represented an international famous hydraulic filters company in its contract dispute with a domestic listed company, and succeeded in recovering USD 2.2 million (RMB 15 million);
